Referees’ Privacy Notice

Letlole La Rona Limited (“LLR,” “we,” “us,” “our”) is the data controller responsible for deciding why and how your personal data is processed when you are identified as a referee by a job applicant. This privacy notice explains how we collect, use, and share your personal data. It also outlines your rights under the Data Protection Act and how you can exercise them.

We collect personal data about you from the following sources:
  1. directly from the job applicant who identifies you as a referee during their recruitment process; and
  2. directly from you, when you provide feedback during the reference-check process.
Where personal data is not obtained directly from you, we will inform you of the source and the categories of data collected.
We process your personal data for the purposes below:

Where we rely on legitimate interests, we ensure that the processing is necessary, proportionate, and does not unfairly impact your rights or freedoms.
Providing referee details is part of the recruitment process. If you choose not to provide information when requested, we may be unable to complete reference checks, which could impact the applicant’s recruitment outcome.
We may share your personal data with third-party service providers engaged in the recruitment process, such as background-check providers, who are strictly limited to processing data only for recruitment purposes.
In some cases, your personal data may be transferred to countries outside Botswana as part of the recruitment process (e.g., where background check providers or recruitment platforms are based internationally). Where this occurs, we rely on adequacy decisions, implement appropriate safeguards or rely on permitted derogations under the Data Protection Act.
Personal data of referees will be retained only for as long as necessary to complete the recruitment process. Once the recruitment process is complete, your data will be securely deleted or destroyed in line with our Data Retention and Disposal Policy.
You have the following rights:
  1. Right of access – request confirmation and a copy of your personal data.
  2. Right to rectification – correct incomplete or inaccurate data.
  3. Right to erasure – request deletion of your data in certain cases.
  4. Right to restriction – limit how we process your data in defined circumstances.
  5. Right to object – you have the right to object to processing based on legitimate interests
These rights may be limited depending on the legal basis for processing. Please contact us to exercise your rights. You also have the right to lodge a complaint with the Information and Data Protection Commission.
